This website is operated by Flooring Rugs & More as an online retail store for the sale of rugs, flooring products, and associated accessories to customers throughout Australia. By accessing this website for any purpose — whether to browse, research, or purchase — you agree to be bound by these Terms and Conditions and our Privacy Policy, both of which are incorporated into and form part of your agreement with us.

We reserve the right to modify, suspend, restrict access to, or discontinue any part of this website at any time and without prior notice, including for routine maintenance or security reasons. We will not be liable for any loss or inconvenience caused by website unavailability.

The information and content on this website are provided for general information purposes relating to our products and services. While we take reasonable care to ensure accuracy, we do not warrant that all content is complete, current, or error-free at all times.

Eligibility & Account Registration

To place an order or create a customer account with Flooring Rugs & More, you must be at least 18 years of age and have the legal capacity to enter into a binding contract. By placing an order, you represent and warrant that you meet these eligibility requirements. If you are placing an order on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

You may purchase from our website as a registered account holder or as a guest. If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials. You must promptly notify us of any suspected unauthorised use of your account. We accept no liability for losses arising from your failure to maintain the security of your account credentials.

You agree to provide accurate, complete, and current information when creating an account or placing an order. We reserve the right to suspend or terminate accounts where inaccurate information has been provided or where these Terms have been breached.

Product Information & Accuracy

We make every reasonable effort to ensure that product descriptions, dimensions, specifications, materials, and imagery published on our website are accurate and representative of the products we supply. Our product descriptions are prepared with care and are reviewed regularly.

You acknowledge and accept the following inherent characteristics and limitations that apply to our product category:

  • Colour variation: Rug and flooring colours as displayed on screen are subject to variation caused by differences in monitor calibration, screen resolution, ambient lighting, photographic conditions, and manufacturing dye lot differences between production runs. Colours viewed on screen should be treated as a guide only, not an exact representation. We strongly recommend requesting a physical sample before purchasing where colour accuracy is critical to your decision.
  • Dimensional tolerances: Handmade, hand-tufted, and woven rugs are manufactured to specified dimensions but may exhibit dimensional variation of plus or minus 3 to 5 percent from stated measurements. This is inherent to artisanal production processes and is not considered a manufacturing defect.
  • Natural fibre characteristics: Products made from wool, jute, sisal, cotton, and other natural fibres will exhibit natural variations in texture, shade, pile height, and patterning between individual pieces. These are characteristics of natural materials, not defects.
  • Timber and flooring variation: Timber and engineered flooring products exhibit natural grain, colour, and figure variation between individual boards. This is an inherent and desirable quality of natural timber products and is not considered a fault.
  • Imagery: Product photographs are provided for illustrative purposes. Styling props, furniture, and room settings shown in product imagery are not included with the purchase.
Accuracy Disclaimer

Where a product is found to be significantly different from its description or images in a way that a reasonable person would not have expected, your rights under the Australian Consumer Law apply regardless of this clause. This clause addresses minor, inherent, or industry-standard variations only — not material misdescription.

Pricing, GST & Currency

All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) at the current rate of 10%, unless otherwise expressly stated. Shipping costs are calculated separately and displayed clearly at checkout before payment is finalised.

We reserve the right to change the price of any product at any time without prior notice. Price changes will not affect orders that have already been accepted by us. The price applicable to your order is the price displayed on the website at the time your order is submitted.

Pricing Errors

Despite our best efforts, pricing errors may occasionally occur on our website as a result of technical issues, data entry errors, or third-party system integration faults. Where a pricing error affects an order you have placed, we will contact you as soon as the error is identified and before your order is dispatched. In such circumstances, you will be offered the option to proceed with your order at the correct price or to cancel the order for a full refund. We are not obligated to honour a manifestly incorrect price that a reasonable person would recognise as an error.

Comparative Pricing & Strike-Through Prices

Where we display a strike-through, “was” price, or comparative price on a product, that comparative price represents the product’s previous standard selling price on our website for a genuine period of time prior to the current promotional price. We comply with our obligations under the ACL and ACCC guidelines regarding the truthful representation of savings and comparative pricing. If you have a query about the basis of a comparative price, please contact us.

Orders & Acceptance

All orders placed through our website are subject to acceptance by us and to product availability at the time of processing. Submitting an order through our checkout constitutes an offer by you to purchase the relevant products on these Terms and Conditions.

Order Confirmation vs Acceptance

An automated order confirmation email sent to you at the time of checkout acknowledges receipt of your order but does not constitute our acceptance of your order. A binding contract between you and Flooring Rugs & More is formed only when we dispatch your order and provide you with a shipping confirmation email containing your tracking information.

When We May Decline or Cancel an Order

We reserve the right to decline, cancel, or limit the quantity of any order at our reasonable discretion in circumstances including:

  • aThe product is unavailable, out of stock, or has been discontinued after your order was placed
  • bWe are unable to verify your payment, billing address, or identity details satisfactorily
  • cWe have reasonable grounds to suspect fraudulent, deceptive, or abusive ordering activity
  • dA pricing error has affected the order and you have been notified in accordance with Clause 5
  • eYour delivery address falls outside our current delivery coverage area
  • fYour order exceeds reasonable personal-use quantities in a manner consistent with commercial resale intent without prior trade approval
  • gAny other circumstance that makes fulfilment impossible or commercially unreasonable for reasons outside our control

Where an order is cancelled by us after payment has been received, a full refund will be issued to your original payment method within 5 to 10 business days, depending on your financial institution.

Payment

Payment for all orders must be received in full before we process and dispatch your order. We do not offer credit terms or invoice-based payment for standard retail orders. Trade account arrangements may be available to approved customers — please contact us to enquire.

We accept the following payment methods, subject to availability at the time of checkout:

  • Visa, Mastercard, and American Express credit and debit cards
  • PayPal
  • Afterpay (Buy Now Pay Later — subject to Afterpay’s own eligibility and terms)
  • Zip Pay (Buy Now Pay Later — subject to Zip’s own eligibility and terms)
  • Shop Pay, Apple Pay, and Google Pay where available

By submitting your payment details, you authorise us to charge the total order amount to your nominated payment method. You represent and warrant that you are the authorised holder of the payment instrument used and that sufficient funds or credit are available to complete the transaction.

Payment Security

All payment transactions are processed by PCI DSS-compliant third-party payment providers. We do not store, receive, or have access to your complete credit or debit card number. Your payment information is transmitted directly to and processed by our payment provider using industry-standard TLS encryption. For details on how payment data is handled, please refer to your payment provider’s privacy and security documentation.

Buy Now Pay Later (BNPL)

Where you elect to use Afterpay, Zip Pay, or another BNPL product, you are entering into a separate credit arrangement governed by that provider’s terms and conditions. We are not a party to that arrangement and accept no responsibility for the conduct of BNPL providers, any fees or charges imposed by them, or any adverse credit consequences arising from your use of their service.

Delivery & Shipping

We deliver to addresses throughout Australia, including metropolitan, regional, and rural locations. We do not currently offer international delivery. Shipping costs are calculated at checkout based on your delivery postcode and the weight and dimensions of your order.

Delivery Timeframes

Estimated delivery timeframes are provided as a guide only and are not guaranteed. Actual delivery times are affected by a range of factors including your location, warehouse stock availability, carrier scheduling and regional capacity, public holidays, and periods of peak demand. As a general guide, deliveries within metropolitan areas typically take 1 to 2 weeks from dispatch, while regional, rural, and remote addresses may take 2 to 4 weeks or longer.

Important — Delivery Timeframes

Estimated delivery windows are a guide only. We do not guarantee delivery by a specified date. We will not be liable for loss, inconvenience, or additional costs arising from delivery delays that are within industry-standard variations or caused by factors beyond our reasonable control, including carrier delays, adverse weather, public holidays, or remote area logistics constraints.

If you have a time-critical requirement, please contact us before ordering to assess whether your requirements can realistically be met.

Your Delivery Responsibilities

  • You are responsible for ensuring the delivery address provided at checkout is accurate, complete, and accessible to freight carriers. Errors in delivery information may result in failed deliveries, redelivery fees, or delays for which we are not responsible.
  • If you are not available at the time of delivery, the carrier may leave a calling card for redelivery scheduling or depot collection. Additional redelivery fees may apply if a second delivery attempt is required due to your unavailability.
  • If a delivery fails as a result of an incorrect address you provided, or because the address is inaccessible to our carrier, any additional costs incurred for redirection or redelivery are payable by you.

Inspection on Delivery

We encourage you to inspect your delivery at the time it is received and to note any visible damage to the outer packaging on the carrier’s delivery documentation before signing. If you identify damage to the packaging that may indicate damage to the product, please photograph both the packaging and the product immediately and contact us within 48 hours at info@flooringrugsandmore.com.au.

Risk & Title

Risk in the products passes to you at the time they are delivered to your nominated address and accepted by you or left at a safe drop location. From that point, you are responsible for any loss, damage, or deterioration of the products.

Title (ownership) in the products passes to you only upon receipt by us of payment in full for those products. Until full payment is received, the products remain our property. In the unlikely event of a payment reversal, chargeback, or fraud confirmed after delivery, we reserve the right to take all steps available to us to recover the products or their full value.

During any period where products are in transit but have not yet been delivered to you, risk remains with us (as the shipper) in the event of loss or damage caused by the carrier. We will investigate and pursue claims with the carrier in such circumstances and will provide you with an appropriate remedy in accordance with the ACL where a confirmed transit loss or damage has occurred.

Returns, Exchanges & Refunds

Our full returns policy is set out in the separate Returns & Exchanges Policy published on our website, which forms part of these Terms and Conditions by reference. ACL Rights — Unaffected by This Policy

Nothing in our Returns and Exchanges Policy, and nothing in this Clause, excludes, restricts, or modifies your rights under the Australian Consumer Law. The change of mind return terms described above are a voluntary goodwill policy that operates in addition to — not instead of — your statutory ACL rights. Where a product has a major failure, is significantly misdescribed, or poses a safety risk, your ACL rights apply fully regardless of the timeframes, fees, and credit-note remedy described in this clause.

Australian Consumer Law

Our products come with consumer guarantees under the Australian Consumer Law (ACL) that cannot be excluded, restricted, or modified by contract. These guarantees are automatic and apply regardless of anything else stated in these Terms and Conditions, our Returns Policy, or any other document we publish.

Consumer Guarantees for Goods

Under the ACL, when you purchase goods from us, we guarantee that the goods will:

  • Be of acceptable quality — safe, durable, free from defects, and fit for the purposes for which such products are commonly supplied
  • Be fit for any particular purpose we indicate or that you make known to us before the purchase
  • Match their description as given on our website, product labels, and in any other representation we make
  • Match any sample or demonstration model we have shown you
  • Come with full title, undisturbed possession, and no undisclosed encumbrances

Remedies for Failure to Meet Consumer Guarantees

Major failure: If a product has a major failure — meaning a failure that a reasonable consumer would not have bought the product knowing about, or that significantly affects what you can do with it, or that cannot be fixed within a reasonable time — you may choose between a full refund, a replacement of identical or equivalent goods, or compensation for the reduction in value of the product.

Minor failure: If the failure is minor, we may choose to repair the product, provide a replacement, or provide a refund. You are not entitled to reject the product in the case of a minor failure if we are willing to repair it within a reasonable time.

Our Statutory Commitment

We will honour our ACL obligations fully and promptly. We will not attempt to limit your remedies for faulty goods to store credit, time-limited claims windows, or internal policy terms. If you have a legitimate ACL claim, please contact us directly and we will work to resolve it appropriately under the law. If you are dissatisfied with our response, you may contact the ACCC at accc.gov.au or your state or territory fair trading office.

Manufacturer Warranties

Some products may also come with a manufacturer warranty separate from your ACL consumer guarantee rights. Where a manufacturer warranty applies, the terms and duration of that warranty are set by the manufacturer, not by us. Your ACL rights exist independently of and in addition to any manufacturer warranty.

Promotions, Discounts & Codes

From time to time we offer promotional pricing, sale events, discount codes, and special offers on our website. The following conditions apply to all promotional offers unless otherwise expressly stated at the time the offer is made.

  • Non-retroactive: Promotional prices, discounts, and codes cannot be applied to orders that have already been placed and confirmed. No price adjustment will be made after an order has been accepted by us.
  • Non-combinable: Only one promotional code or discount can be applied per order unless the terms of a specific promotion expressly permit stacking.
  • Subject to modification or withdrawal: We reserve the right to modify, extend, or withdraw any promotional offer at any time without prior notice.
  • Product exclusions: Certain products, categories, or brands may be excluded from promotional offers. Exclusions will be noted in the promotional terms where applicable.
  • No cash value: Promotional discounts and codes have no cash value and cannot be redeemed for cash. They may not be transferred, shared, or sold.
  • Misuse: We reserve the right to cancel any order, disable any account, and void any discount where we have reasonable grounds to believe that a promotional offer has been misused, circumvented, or exploited in bad faith.
Advertising & Savings Claims

All savings representations, percentage discounts, and comparative pricing shown in promotional materials are made in compliance with the ACL and ACCC guidelines on misleading conduct. Comparative prices are genuine prior selling prices on our website.

Product Availability & Substitution

We endeavour to maintain accurate and up-to-date stock levels on our website. However, inventory errors may occasionally occur as a result of system timing differences, simultaneous orders, supplier delays, or warehouse processing issues. The display of a product as “in stock” at the time of your order does not guarantee availability at the time of fulfilment.

If a product becomes unavailable after your order has been placed and accepted, we will contact you promptly and offer one or more of the following options:

  • A full refund to your original payment method
  • Placement of the item on backorder, with an estimated restocking date communicated to you, and the option to cancel for a full refund if the wait is unacceptable to you
  • An offer of a comparable substitute product of equal or greater value, at our discretion and subject to your acceptance

We will not dispatch a substitute product without your express agreement. If we do not receive a response from you within a reasonable time, we will cancel the affected portion of your order and refund the relevant amount.

Limitation of Liability

Nothing in this clause limits or excludes any liability that cannot lawfully be limited or excluded under the Australian Consumer Law or any other applicable legislation, including liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or liability for any consumer guarantee under the ACL.

Subject to the above, and to the maximum extent permitted by law, our aggregate liability to you for any claims arising out of or in connection with these Terms and Conditions, the use of this website, or the supply of products — whether in contract, tort, negligence, or otherwise — is limited to the amount actually paid by you for the specific product or order giving rise to the claim.

To the maximum extent permitted by law, we specifically exclude liability for:

  • Indirect, consequential, incidental, or punitive loss or damage of any kind

  • Any loss arising from delivery delays within industry-standard timeframe variations

ACL Preservation

This limitation of liability clause does not apply to, and does not affect, your statutory consumer guarantee rights under the ACL. Where the ACL gives you a right to a remedy that would otherwise be excluded by this clause, that right applies.

Unfair Contract Terms

These Terms and Conditions constitute a standard form consumer contract as defined under the ACL. Since 9 November 2023, it has been unlawful to include, propose, or rely on unfair contract terms in standard form contracts with consumers in Australia, pursuant to amendments to the ACL under the Treasury Laws Amendment (More Competition, Better Prices) Act 2022.

We have endeavoured to draft these Terms and Conditions to be fair, transparent, and compliant with the ACL’s unfair contract terms provisions. Where any term in these Terms and Conditions is found by a court or the ACCC to be unfair or unenforceable under the ACL, that term will be void to the extent of the unfairness. The remainder of the Terms and Conditions will continue in full force and effect.

ACCC Compliance — Recent Enforcement Context

We are aware that the ACCC actively monitors ecommerce return policies, delivery timeframe representations, and standard form contract terms for ACL compliance. Our Terms and Conditions, Returns Policy, and marketing representations have been prepared with awareness of ACCC enforcement priorities. If you believe any part of our Terms may be unfair or misleading, please contact us — we take compliance seriously.

Force Majeure

We shall not be in breach of these Terms and Conditions, and shall not be liable for any failure or delay in performing our obligations, where such failure or delay results from circumstances genuinely beyond our reasonable control. Such circumstances include, but are not limited to:

  • Natural disasters, earthquakes, floods, bushfires, or severe weather events
  • Pandemic, epidemic, or public health emergency declarations affecting our operations or supply chain
  • Acts of government, war, civil unrest, terrorism, or national emergency
  • Strike, industrial action, or labour dispute affecting our suppliers or freight carriers
  • Failure or unavailability of telecommunications infrastructure, power supply, or internet services
  • Disruption to supply chains, port closures, or significant freight carrier capacity constraints
  • Any other event that is genuinely unforeseeable and beyond our reasonable control

Where a force majeure event occurs, we will notify you as soon as reasonably practicable. If a force majeure event causes a delay of more than 30 days to the fulfilment of your order, you will be entitled to cancel your order and receive a full refund of any amounts paid.

We are committed to resolving any concerns, complaints, or disputes arising from your experience with Flooring Rugs & More fairly and efficiently. If you have a complaint, we strongly encourage you to contact us directly in the first instance, as most issues can be resolved through direct communication without the need for formal proceedings.

Internal Complaints Process

To raise a complaint or dispute, please contact us at info@flooringrugsandmore.com.au with a clear description of your concern and your order number where relevant. We will acknowledge your complaint within 2 business days and aim to provide a substantive response within 10 business days.

If we make material changes to these Terms — changes that substantially affect your rights or obligations — we will take reasonable steps to bring those changes to your attention, which may include a notice on our website homepage or an email notification to registered customers.

Your continued use of this website or the placement of any new order after updated Terms have been published constitutes your acceptance of the revised Terms. These Terms and Conditions do not affect any rights that arose under a prior version of the Terms in connection with an order that was placed and accepted before the updated Terms took effect.
